Terms of Service

These Terms of Service ("Terms") govern your access to and use of ALABALA (the "Service"), operated by ALABALA ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

2. Accounts

You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

3. Credits and payments

The Service operates on prepaid credits. Each AI generation, mockup render, or export consumes credits at the rates published on our pricing pages. You may purchase additional credit packs at any time. Payments are processed by Stripe and are subject to Stripe's terms.

Credits are non-transferable and tied to the purchasing account.
Credits do not expire.
Bonus credits granted by us (e.g. welcome credits, promotions) may be revoked if abused.

4. Acceptable use

You agree not to use the Service to:

Generate content that is illegal, defamatory, or violates the rights of others.
Generate sexual content involving minors, or non-consensual intimate imagery.
Generate content that misrepresents real people in misleading or harmful ways.
Attempt to reverse-engineer the Service or circumvent rate limits or abuse-prevention systems.
Automate account creation or use the Service through unauthorized scripts.

We reserve the right to suspend or terminate accounts that violate these rules and may report illegal content to the appropriate authorities.

5. Ownership of content you generate

Subject to your compliance with these Terms, you own the artwork and mockups you generate using the Service. We retain rights to the underlying software, models, and platform.

You're responsible for ensuring your generated content does not infringe third-party rights (trademarks, copyrights, likeness, etc.).

6. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features with reasonable notice. Scheduled maintenance is announced in advance when possible.

Fulfillment services (3PL)

If you use ALABALA Fulfillment, you authorize us to receive, store, handle, pick, pack and ship your inventory from our Houston, TX warehouse, and to connect to your marketplace accounts (Shopify, Etsy, TikTok Shop, Amazon FBM) to import orders and write back fulfillment status and tracking. You are responsible for the accuracy of your product, inventory and order data, for any duties, taxes or carrier surcharges, and for ensuring the goods you send are legal to store and ship. Title to and risk of loss for inventory remains with you; we are not a buyer or seller of your goods. Fulfillment fees (receiving, storage, pick, pack, shipping, returns handling and similar) are charged per the rates and line items shown in your Fulfillment billing page and are due as incurred. We may dispose of abandoned inventory after reasonable notice and after fees remain unpaid.

7. Termination

You may close your account from Settings → Account at any time. We may terminate or suspend your access for material violations of these Terms, suspected fraud, or abuse. Upon termination, unused purchased credits are eligible for refund per our refund policy.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that AI-generated content will be accurate, suitable for a particular purpose, or free of bias or error.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the amount you paid us in the twelve months preceding the claim.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
